Terms of Sale and Rental
These Terms of Sale (hereinafter the "Terms of Sale") apply to every accommodation booking made by Travelers on the Voyino platform (voyino.com), published by KATALUXE SARL U, Lomé, Togo.
These Terms of Sale supplement the Terms of Use, from which they are inseparable. By making a booking, the Traveler accepts the Terms of Use and these Terms of Sale without reservation.
1. Scope
These Terms of Sale govern exclusively the commercial transactions for short-term accommodation bookings made through the Voyino Platform between Travelers and Hosts. They apply to every booking made from 23/04/2026 onwards.
2. Booking process
Booking accommodation on Voyino follows these steps:
- Selecting the accommodation and reviewing the Listing in detail (description, photos, amenities, house rules, cancellation policy).
- Choosing the stay dates and the number of occupants.
- Displaying the price summary, comprising the rent, any cleaning fee and the Voyino service fee.
- Secure online payment through our third-party payment provider.
- Receiving the booking confirmation email.
No booking is final before the confirmation email is received.
3. Price
The total price displayed at booking comprises all of the following:
- The rent: the nightly price set freely by the Host, multiplied by the number of nights booked.
- The cleaning fee: an optional fixed amount set by the Host to cover cleaning of the accommodation.
- The Voyino service fee: calculated as a percentage of the subtotal (see article 4).
All prices are expressed in euros (EUR) or in the applicable local currency. Any additional local taxes that may be owed by the Traveler under the regulations of their country of residence are added to the amounts displayed.
4. Voyino service fee
The service fee constitutes the remuneration of KATALUXE SARL U for making the Platform available, securing transactions and providing the associated services (customer support, payment protection, etc.).
Calculation formula:
Subtotal = (nightly price × number of nights) + cleaning fee Service fee = rounded to the nearest whole unit (subtotal × 12%) Total = subtotal + service fee
This 12% service fee is borne exclusively by the Traveler and applies to every booking. It is distinct from the commission charged by Voyino to the Host (governed by the Terms of Use), is never added to the price paid by the Traveler, and is not reduced by any commission exemption the Host benefits from.
The Voyino service fee (12%) is never refundable, whatever the applicable cancellation policy, the reason for cancellation or the circumstances, including force majeure.
5. Payment
Payment is made exclusively online, securely, through an approved third-party payment provider. The Traveler's banking details are transmitted directly and exclusively to the payment provider; they are never stored on Voyino's servers. The precise identity of the provider will be communicated when online payments are activated.
Payments are debited immediately on booking confirmation.
Transaction security is ensured by:
- SSL/TLS encryption (HTTPS)
- 3D Secure strong authentication (in accordance with the PSD2 directive for European transactions)
- The payment provider's anti-fraud systems
Accepted payment methods include bank cards (Visa, Mastercard, American Express) and other methods available depending on the Traveler's region.
6. Booking confirmation
The booking is definitively formed on the date the automatic confirmation email is sent to the Traveler by Voyino. That email constitutes proof that the rental contract between the Host and the Traveler has been formed.
KATALUXE SARL U reserves the right to cancel any booking showing serious indications of fraud or breach of these Terms of Sale, with no compensation other than a full refund of the sums paid by the Traveler.
7. Cancellation policies
Each Host selects a cancellation policy from the three options offered by Voyino. The policy applicable to each accommodation is clearly shown on the Listing page before payment is validated.
Absolute rule applying in every case: the Voyino service fee (12%) is never refundable.
7.1 Flexible policy (default policy at MVP launch)

Eligible refunds are processed within 5 to 10 working days to the payment method used for the original booking.
8. Cancellation by the Host
Except in cases of force majeure duly evidenced by an official document sent to contact@voyino.com, cancellation of a confirmed Booking by a Host is strictly prohibited.
Where a Host cancels without justification, the Traveler is refunded in full, including the Voyino service fee. Disciplinary measures may be applied to the Host at fault, up to and including suspension or permanent deletion of their account and Listings.
9. Force majeure
In the event of force majeure (natural disaster, armed conflict, pandemic, government restriction legally and effectively preventing the Traveler from travelling or from accessing the accommodation), the Traveler or the Host may request cancellation of the Booking free of charge by sending official evidence to contact@voyino.com with the subject "Force majeure — booking [number]".
Whether an event qualifies as force majeure is assessed at the sole discretion of KATALUXE SARL U, which undertakes to decide within a reasonable time.
10. Dispute handling
Where a dispute arises between a Host and a Traveler concerning a stay, the following procedure is recommended:
- Report to Voyino within 48 hours of check-in by email to contact@voyino.com, subject: "Booking dispute [number]". After that period, the stay will be presumed to have taken place in accordance with the Listing.
- Review of the case: Voyino will examine the material submitted by both parties within 5 working days.
- Mediation: Voyino may, at its discretion, propose mediation between the parties.
- Legal action: as a last resort, before the courts having jurisdiction under article 14.
As KATALUXE SARL U is not a party to the rental contract, any decision by Voyino in a dispute is taken in good faith but without guarantee of outcome.
11. Voyino's liability
KATALUXE SARL U is not a party to the rental contract concluded between the Host and the Traveler. Its contractual liability is strictly limited to:
- Making the matchmaking Platform available.
- Securely processing and transmitting payments to the third-party payment provider.
- Complying with these Terms of Sale within their scope.
KATALUXE SARL U does not guarantee the quality, conformity, safety or accuracy of the accommodation or the Listings.
12. Statutory consumer guarantees
Consumer Travelers benefit from the statutory guarantees applicable in their country of residence. The mandatory protective provisions of consumer law in the Traveler's country of residence apply and cannot be set aside by the choice of Togolese law.
For Travelers residing in the European Union, Directive 2011/83/EU on consumer rights and its national transposition provisions remain applicable in their mandatory provisions.
13. Right of withdrawal — not applicable
In accordance with applicable legal provisions, the right of withdrawal does not apply to accommodation bookings made on Voyino where a specific date or period of stay is determined.

- France and EU: Article L221-28 12° of the French Consumer Code — exception to the right of withdrawal for contracts for the provision of accommodation services, other than for residential purposes, on a specified date or for a specified period.
14. Governing law and jurisdiction
These Terms of Sale are governed by, interpreted and performed in accordance with Togolese law.
In the event of a dispute not resolved amicably, the parties agree on the exclusive jurisdiction of the Commercial Court of Lomé (Togo).
For consumers residing in the European Union, the mandatory provisions of consumer law in the consumer's country of residence remain applicable, in accordance with the applicable conflict-of-law rules.
